The initiator of the action, which supports pharmacists around the world in the fight against COVID-19 is FIP and PGF Poland.

1. General information

Privacy policy / Terms and conditions

§1. GENERAL PROVISIONS

  1. The organiser of the campaign named “Pharmacy Heroes”, hereinafter referred to as “the Campaign”, is Polska Grupa Farmaceutyczna Spółka Akcyjna with the registered seat in Łódź, ul. Zbąszyńska 3, 91-342 Łódź, entered into the Register of Entrepreneurs of the National Court Register maintained by the District Court for Łódź – Śródmieście in Łódź, the 20th National Court Register Division, under the number KRS 0000471297, NIP [Tax Identification Number] 527-264-39-21 with the share capital: 372,000,000.00 PLN, hereinafter referred to as “the Organiser”. The Organiser’s contact details: pharmacyheroes@pgf.com.pl.
  2. The Campaign will take place from 1 April 2020 until further notice, pursuant to the terms specified in these Rules and Regulations.

§2. CONDITIONS FOR PARTICIPATION IN THE CAMPAIGN

  1. The Campaign is open to all pharmacists. In order to participate in the Campaign one must send to the Organiser an application with a photograph of himself/herself with the hands shaped as the letter “P”.
  2. A proprietary photograph in JPG format, taken with the use of any technique, should be sent to the following e-mail address: pharmacyheroes@pgf.com.pl.
  3. By submitting the application the applicant declares that the submitted photograph does not violate any third party copyright or any legally protected third party rights or interests and that the applicant shall be solely responsible if this declaration is found to be untrue.
  4. In addition, by joining the Campaign the applicant declares that he/she accepts the Campaign rules set out in these Rules and Regulations.
  5. By participating in the Campaign and accepting the Rules and Regulations the applicant also declares that he/she holds the exclusive and unlimited copyright and related rights in the submitted photograph and that all the persons appearing or shown on the photographs consent to the publication of their image free of charge in the manner specified in the Rules and Regulations. If the persons shown in the submitted photographs can be recognised, the applicant shall obtain the consent of such persons for publication and public presentation of the photograph so as to be able to present such consent upon a request of the Organiser.
  6. On applying to participate in the Campaign and submitting the photograph, the applicant authorises the Organiser, free of charge, to utilise the photograph (without any time or territorial limitations) for any purpose, including but not limited to, in publications and other media of the Organiser, in all fields of exploitation, including in particular:
    1. Fixing and reproduction by printing or a similar technique as well as fixing in part or in whole as well as reproduction by use of artistic, photographic technique, in the form of digital recording, regardless of the standard, system or format,
    2. Entering into computer memory,
    3. Recording on devices for multiple image reproduction with the use of image storage media, including digital media, including reproduction, distribution and playback of the photographs as well as their other use in accordance with the provisions of the Rules and Regulations,
    4. Use for marketing and promotion purposes, including advertising of the Organiser,
    5. Other cases of distributing the photographs, including display of the photographs and their copies, their processing, including digital processing and introducing changes and modifications to the photographs, in particular as a result of technical requirements related to the above mentioned methods of distribution, as well as using the effects of such processing and granting permissions for use thereof.
  7. By submitting a photograph for the Campaign the applicant grants his/her consent for presentation of the photograph on Internet websites, in social media profiles and in publications owned by the Organiser and for identifying the authorship of the photographs, subject to marking the photograph with the applicant's name.
  8. In addition the applicant hereby waves the right to any remuneration for the use of the photographs in accordance with the Rules and Regulations.
  9. Out of the all the submitted photographs the Organiser shall select the ones that, in the Organiser’s view, deserve special mention and after digital processing shall publish them on the Campaign website www.pharmacyheroes.com and in the social media promoting the Campaign (in particular:

  10. Submitting a photograph implies granting the consent for the placement of the photograph and the image on Internet websites, in social media, in presentations, on television, during fairs and exhibitions, training sessions or via the Internet in any (technical) manner in the fields of exploitation indicated in Section 6 above.

§3. COMPLAINTS

  1. Any complaints related to the manner of carrying out the Campaign can be submitted in writing to the email address pharmacyheroes@pgf.com.pl.
  2. A complaint should contain: full name and the email address of the complainant as well as the full description and grounds for the complaint. A complaint can also be sent by post using registered mail to the address of the Organiser or delivered to the Organiser’s registered seat with receipt confirmation.
  3. Complaints shall be handled by the Organiser within 7 calendar days from their receipt by the Organiser.
  4. Notification of the Organiser’s decision on the complaint shall be sent to the person submitting it to the address provided in the written complaint, within 7 days from handling the complaint.

§4. PERSONAL DATA

  1. The applicant shall provide to the Organiser the following personal data: first name, surname, image, occupation and the email address – for the purpose related to application to participate in the Campaign.
  2. Pursuant to Art. 13.1 of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (hereinafter: GDPR), the Organiser hereby informs that:
    1. The controller of the personal data of the Campaign participants is the Organiser, who can be contacted at the email address pharmacyheroes@pgf.com.pl,
    2. The personal data provided will be processed for the purpose of carrying out the Campaign in a manner consistent with the Rules and Regulations,
    3. The legal basis for processing the personal data provided is Art. 6.1.f of GDPR, that is, processing of the personal data is necessary for the purposes of the legitimate interests pursued by the Organiser, i.e. carrying out the Campaign,
    4. The recipients of the personal data may be entities entrusted with personal data processing in connection with the activity carried out by the Organiser (e.g. entities providing IT services to the Organiser) – on the basis of the relevant personal data processing contracts and ensuring that the above mentioned entities apply adequate technical and organisational measures to ensure protection of the data;
    5. The personal data of the participants shall be processed throughout the duration of the Campaign and after that period only for as long as it is necessary for the purpose of securing the rights or any possible claims (e.g. complaints),
    6. Everyone shall have the right to access the personal data they provided as well as to request their rectification, erasure, restriction of processing, data portability, and to object to their processing;
    7. Everyone shall have the right to file a complaint to the supervision authority, that is, the President of the Personal Data Protection Office, ul. Stawki 2, 00-193 Warszawa,
    8. The provision of personal data is voluntary but it is a necessary condition for participation in the Campaign;
    9. In the implementation of the Campaign no automated decision making or profiling shall take place.
    10. If you wish to exercise the rights indicated above or in other matters related to the personal data provided, please contact the Data Protection Officer at iod@pgf.pl.

§5. FINAL PROVISIONS

  1. Any disputes arising out the performance of the obligations related to the Campaign shall be resolved by the territorially and materially competent common court.
  2. To matters not regulated herein the relevant provisions of the Civil Code and the Act on Copyright and Related Rights shall apply.
